It just gets better for Francois, he went to Guinea and didn’t contract Ebola while in Kazakhstan his advisers dressed him up to look like a stand in for Flanagan and Allen.  And now he has to give all that money back to Russia for the warships he isn’t sending.

 

I am slowly recovering from the Labyrinthitis although I think it has continued to slow me down at the computer, and to cap it all yesterday when I was expecting to finish and send off this Flyer the damn thing decided to overheat and shut itself down every single time I got close, often losing me what I had just done.  Oh what a lovely day it was!

 

I received a mail from Skype telling me the VAT rate I would be paying would be that of the country I am in, previously it was based on the Luxembourg VAT rate, a deal done by Mr Juncker when he was PM of the Grand Duchy.  So why the change?  Too much pressure from the rest of Europe?

 

Has anyone seen what the title of the newly formed amalgam of midi Pyrenees and Languedoc Roussillon will be? Any suggestions? Answers on a postcard please.

 

Were the British government saving money not updating their Air Traffic control computer system? Then it stopped working.  That must mean delayed passengers now have a claim against their airline who will then claim it off of the government and bearing in mind the number of flights involved it can be quite a big pay-out. The European regulation says it is between 250€ and 600€ for a 3 hour delay with the amount being based on length of flight.

 

It would appear the traditional UK political parties need not be quite as worried about UKIP as it previously thought, they seem to shoot themselves in the foot with miraculous ease. There is no truth in the rumour that they are fielding a candidate called Rolf Cosby.

Lost in France

 

Having watched the shopping frenzy being reported on British television, I’ve felt smugly about how I’m not a part of it down here in the Aude.  Black Friday, Cyber Monday and everything else has passed me by, but for some reason a feeling of desperation and a need to buy stuff has been imbued into me.  So as I went out to buy some stationery items, I could feel that urgency of a recognisable pre-Christmas shopping frenzy rising inside.   In one shop I greeted ‘bon jour’ by virtually every worker there.  It was a shop called something like ‘Fêtes du Jour’ - so full of presents and decorations for every occasion you would think this close to Christmas it would be pretty much full of people too.  There was barely a soul and with Father Christmas hats at 0.79€ each – what’s going on?

 

At Tridome, the chaps in the Christmas Tree department in the parking lot were having a whale of a time trying out some machine that wrapped the trees up to make them manageable.  This reminded me of a flight I once took in Russia, where every single person with a case had it wrapped in endless rolls of cling film by a little man with a machine.  No one wanted to get their luggage tampered with, but at the other end, funnily enough no one was able to identify their cases.

As I left the parking lot I did have a very childish snigger when a woman entered the Christmas Tree area and said rather loudly, ‘je cherche ma bush’.

And Another Year Comes to an End

 

At this time of the year, people’s minds are very much focused on Christmas and families. For those of you travelling to spend time with family, let’s hope those journeys are trouble-free and flights, ferries, etc. run as planned.

 

The end of the year is always a good time for reflection and this year, we have had much to think about for our clients. However, as well as managing current financial risks for our clients, we are also forward looking. So I thought it would be a good time to do a quick review of some of the things that are on the horizon for 2015.

 

The UK Pensions Reform is big and we now have a reasonable amount of certainty of the changes taking place in April and it is unlikely that there will be any more changes of substance between now and then. The reform brings more flexibility, which is good, but the reality is that for many, the taxation outcome will be a deterrent against fully cashing in pension pots. This is likely to be even more so in France, where it is not just the personal tax and possible social contributions that are an issue, but also whatever you have left of the pot will then be taken into account in valuing your assets for wealth tax, as well as being potentially liable for French inheritance taxes.

 

The EU Succession Rules will come into effect in August. While the EU thinking behind this is good, i.e. to come up with a common EU-wide system to deal with cross-border succession, the practical effects will still have issues. The biggest issue for French residents is, of course, French inheritance taxes. Therefore, it may not necessarily be the case that the already tried and tested French ways of protecting the survivor and keeping the potential inheritance taxes low for your beneficiaries should be given up in favour of selecting the inheritance rules of your country of nationality. There is the UK General Election in May and who knows whether or not that will actually be followed at some point by a referendum on the UK’s membership of the EU. Nor do we know what the outcome of such a referendum would be and so there is really no point in speculating, at this stage.

 

For UK non-residents, we are expecting the introduction of UK capital gains tax on gains arising from UK property sales from April, subject to there not being any changes in the next budget. We had also expected that non-residents would lose their UK personal allowance entitlement for income arising in the UK, but we now know that this will not happen next year. The Autumn Statement confirmed that it is a complicated issue and if there are to be any changes in the future, these will not take place before 2017. Of course, there could be a change in government and so it might be back on the agenda sooner!

 

We will also have the usual round of French tax changes, although this year, the expected changes are much less extensive than previous years. The French budget is still winding its way through the parliamentary process and I will provide an update on this next month.

 

Turning to investment markets, my personal opinion is that the main factor that will have an impact in 2015 is central bank monetary policy. Whether this results in tighter or looser policy from one country to another remains to be seen. What is clear is that the prospect of deflation in the Eurozone remains a real threat and not only needs to be stopped, but also needs to be turned around with the aim of eventually reaching the target of being at or just below 2%. Other central banks around the world have a similar target and in areas where recovery is clearly underway, the rate of price inflation and wage inflation also needs to increase before we are likely to see the start or interest rate movements in the right direction.

 

Last but not least, with effect from 1st January 2015, under the terms of the EU Directive on administrative cooperation in the field of direct taxation, there will be automatic exchange of information between the tax authorities of Member States for five categories of income and capital. These include income from employment, director’s fees, life insurance products, pensions and ownership of and income from immoveable property. The Directive also provides for a possible extension of this list to dividends, capital gains and royalties.

 

So for now, I wish you all a Merry Christmas and I hope that 2015 is a year of peace for all.

THE NEW REGIME OF AUTOENTREPRENEUR.  WHAT IS GOING TO CHANGE FOR YOU IN JANUARY 2015.

 

If you have chosen the status of  autoentrepreneur you need to be aware of the new system  which will apply  from January 2015  :

 

-          All autoentrepreneurs will  now have to pay CFE  (Cotisation Foncière des Entreprises, tax on business premises) but not  in the year of creation of the  business (previously the exoneration was valid for three years).  This is a fixed amount which doesn’t depend on profits.  Rates are determined by local authorities,

-          New mandatory registration for  tradesmen/women  autoentrepreneurs in the Répertoire des Métiers (Directory of Tradespeople). For other kind of business, you will need to be registered in the Registre du Commerce et des Sociétés ( Trade and Company Register) .  Those with existing autoentrepreneur business  will have a year to comply with law,

-          Payment of tax for to the Chambre de Commerce (Chamber of Commerce) or Chambre des Métiers (Chamber of Tradespeople).  This is a fixed  percentage on your  turnover and depends on the nature of your activity.  Previously, autoentrepreneurs were exempt from this tax,

-          Obligatory training course prior to start-up for a tradesperson  who is creating  a new business (not mandatory for those  already registered before January 2015 nor for autoentrepreneurs working in commerce),

-          Optional  implementation of a personalized  support system for autoentrepreneurs reaching  the 50%  threshold of the annual turnover ceiling,

-          Legal obligation for certain tradespeople to mention their insurance on their invoices and estimates.  Especially  important for builders, sub-contractors and those involved in renovation who will need to prove they have a ten-year guarantee     Creation of a new single  status of sole trader business (merging  autoentrepreneur, micro business and traditional business model)-   

You will be obliged to declare your turnover every quarter on a form sent the Régime Social des Indépendants (RSI, social securitiy for the self-employed). This form needs to be returned by a certain deadline.  Your contribution to sick benefits, pensions…etc will be calculated on the basis of these figures.  Even if (at first) you do not have any turnover, you will still have to complete the quarterly declaration putting 0 in each box and send it to the RSI. Otherwise, they will send you a “friendly” reminder at a cost of 47 euros.  Be careful if you do not complete the declaration for two years, you will be automatically struck off  the RSI.  You will no longer belong to the system and you will not be able to start a new company for a period of two years.

You can hope that the diamond finesse works for your tenth trick but there is also an extra chance of Q x x of clubs in either hand. Win the trump return in Dummy

and cash the Ace/King of clubs. Return to hand with the Jack of trumps, thereby drawing the last trump, and ruff a club in Dummy. If the Queen drops you can return to hand with the Ace of trumps to cash your club winner, if not, try the diamond finesse.
